Immigration Protection Tribunal Appeals (iPT Appeals)
An IPT appeal refers to an appeal to the Immigration and Protection Tribunal (IPT), an independent body in New Zealand that reviews decisions made by Immigration New Zealand regarding visas and deportation liability

Legal Grounds and Time Limits for Immigration Appeals
An appeal can be lodged if a visa is refused, or on humanitarian grounds in exceptional circumstances. There are strict time limits for appeals, and the process can be complex, so seeking legal advice is strongly recommended.
Immigration Protection Tribunal (IPT) is an independent jurisdiction established under the Immigration Act 2009 to hear appeals. IPT decides appeals made against Immigration New Zealand decisions related to visas and deportation liabilities of individuals. It must be noted that there is a very narrow time window to lodge an appeal.
If this time is lapsed then The IPT will not hear the appeal. People who become unlawful can also submit to The Tribunal an appeal against their deportation liability

Need Help? We’ve Got Answers
1. What is the Immigration and Protection Tribunal (IPT)?
The IPT is an independent tribunal that reviews immigration, deportation, refugee, and protection decisions made by Immigration New Zealand or the Ministry of Business, Innovation and Employment (MBIE).
2. Who can appeal to the IPT?
You can appeal if Immigration New Zealand has declined your residence, temporary visa, or refugee/protection application, or issued you a deportation order, depending on your visa type and situation.
3. What types of decisions can be appealed to the IPT?
You may appeal decisions such as:
- Declined residence visa applications
- Deportation liability or orders
- Refugee or protection status refusals
- Humanitarian considerations related to deportation
4. How much time do I have to lodge an appeal?
You generally have 20 working days from the date of the immigration decision to submit your appeal to the IPT. It’s important to act quickly to avoid missing the deadline.
5. How do I lodge an appeal with the IPT?
You can lodge an appeal by completing the required IPT appeal form, attaching all supporting documents, and submitting it directly to the Tribunal’s office or by post before the deadline.
6. What happens after I file my appeal?
Once your appeal is lodged, the IPT will review your case, request additional documents if needed, and may schedule a hearing. You’ll be notified of the progress and final decision in writing.
7. Can I stay in New Zealand while my appeal is being processed?
In many cases, yes. If you lodge your appeal within the valid timeframe, you may remain lawfully in New Zealand while the IPT considers your case. However, this depends on your visa status and appeal type.
8. Do I need a lawyer or immigration adviser to file an appeal?
While it’s not mandatory, it’s strongly recommended to seek help from a licensed immigration adviser or immigration lawyer to ensure your appeal is properly prepared and represented.
9. How long does the IPT take to make a decision?
The processing time varies depending on the complexity of the case. Some appeals are decided within a few months, while others may take longer, especially those requiring hearings.
10. What happens if my IPT appeal is unsuccessful?
If your appeal is declined, you may have limited options such as applying for Ministerial Intervention or Judicial Review, depending on your individual circumstances and legal grounds.
